TERMS & CONDITIONS
Elizabeth Quay Fun Fair does not offer refunds, returns or exchanges unless required by Australian Consumer law and is at the sole discretion of management. A change in your personal circumstances or change of mind does not entitle you to return or exchange your tickets.
Discounted wristbands cannot be changed for alternative dates or sessions.
Any changes to online tokens or wristbands can only be processed by our ticketing agency by emailing support@megatix.com.au.
There are no refunds if you miss your session.
REFUNDS
Elizabeth Quay Fun Fair does not offer refunds or exchanges as a result of a change in your personal circumstances, mistaken purchases or due to external factors such as, for example, adverse weather. We will only provide a refund or exchange a ticket if an event is cancelled, rescheduled or significantly relocated. We advise that all patrons read through our terms and conditions and FAQs before making a purchase to prevent any issues.
If a session is cancelled, rescheduled or significantly relocated (and You cannot or do not wish to attend the rescheduled or relocated event), You must apply for a refund within a reasonable time after the announcement of the occurrence of the aforementioned. You must apply for a refund by the earlier of: (a) 4 weeks after notification of the reschedule or relocation; or (b) 72 hours prior to the event. If you do not request a refund by that date, you will have agreed to the reschedule or relocation and will not be entitled to claim a refund.
If an event is cancelled, rescheduled or significantly relocated by the Presenter, all liability is limited to the amount for which the ticket was purchased (including booking fees). Credit card processing fees cannot be refunded.
Neither Megatix nor Elizabeth Quay Fun Fair will be liable for any other losses incurred. Unless required by law (including the Australian Consumer Law), neither Megatix or Elizabeth Quay Fun Fair will be liable for any other losses incurred by you as a result of the cancellation, rescheduling or relocation of an event, including any travel and accommodation expenses
In the event that the date, time or venue of a session is rescheduled or changed, your ticket will remain valid for the rescheduled date, time and venue.
Megatix and Elizabeth Quay Fun Fair will not replace any lost, stolen or damaged tickets. Once all tokens or wristbands have been received by the ticket holder, it is the responsibility of the ticket holder to ensure they are kept safe and free from damage. No replacements will be issued. No exceptions.
If Elizabeth Quay Fun Fair authorises Megatix to issue You with a refund, Megatix will refund to You the ticket price + Booking Fee. Credit card processing fees cannot be refunded.
Any booking, delivery and/or postage fees and any credit card processing surcharge charged by Megatix is separate to the refund price and is not subject to a refund.
When a refund is issued, the sum refunded will not necessarily include booking, delivery and/or postage fees and any processing surcharge charged by Megatix to process the refund and pay the refund to You.
Megatix and Elizabeth Quay Fun Fair will not offer You a refund or exchange as a result of a change in your personal circumstances.
Once a refund is processed and sent to your card issuing bank, it can take another 5-7 business days (depending on the bankโs processing speeds) for the refund to post to your account.
You should carefully consider the refund and cancellation policies of travel, accommodation and other goods or service providers when making arrangements for attendance at an event. You may also wish to consider taking out a relevant insurance policy to cover for any losses in the event of cancellation, rescheduling or relocation.
Variations to the lineup and service offering. Elizabeth Quay Fun Fair reserves the right to add, withdraw, reschedule or substitute carnival rides, sideshow games, performers and artists, and/or vary advertised programs, prices, venues and audience capacity at any time without notice.
Where companion cards are applicable, suitable and valid identification must be provided for collection of tickets at the event.
While Megatix and Elizabeth Quay Fun Fair takes all reasonable care to ensure that tickets are correctly priced and only available for sale when intended, sometimes errors may occur. We may cancel an order made as a result of any such error, or offer a suitable alternative. Megatix and Elizabeth Quay Fun Fair are not liable to honour the initial error in tickets or pricing.
CONDITIONS OF ENTRY
Admission to an event is subject to the Elizabeth Quay Fun Fairโs Terms. In particular, the following form part of our terms unless otherwise specified:
You may be denied entry into, or removed from, an event where reasonable grounds to do so have been identified including if you breach these Terms and Conditions, or you are intoxicated, under the influence of illicit drugs, inappropriately attired or adversely affecting the enjoyment of the event by others.
By attending the event, you and each attendee in your group acknowledge and agree that you each may be filmed and/or recorded and you each give permission to Elizabeth Quay Fun Fair and associated organisations to use your image, likeness and voice obtained at the event in all media throughout the world for any purpose and without any compensation.
You agree to comply with all Government directions, orders and regulations (if required) relevant to attending live events, which may be in place at the time of the event
Authenticity and validity of tickets
Entry to an event may be refused if the authenticity or validity of a ticket is questionable, including because the ticket has been damaged or defaced in any way, or has not been purchased from Megatix or other authorised points of sale.
Ticket resale and scalping
Tickets may not, without prior consent of Megatix and Elizabeth Quay Fun Fair, be resold or offered for resale at a premium (including via on-line auction or other unauthorised resale sites). If a ticket is sold or used in breach of this condition, the ticket may be cancelled without a refund and the ticketholder of the ticket may be refused admission. Megatix and Elizabeth Quay Fun Fair will use reasonable efforts to notify you of such action.
SCALPING WARNING: The resale of tickets in certain circumstances is governed by ticket sales legislation and may attract criminal penalties.
Customer Errors
If an error on your behalf results in accidental purchasing of incorrect tickets, incorrect dates or any other general purchase, No refunds will be offered and processed as a result.
